These Terms govern

- any other Agreement or legal relationship with the Owner in a binding manner.
www.toccareterra.it is an electronic store created for the purpose of selling food products via the Internet. In compliance with the Italian legislation referred to in Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, the "Consumer Code").
The customer who accesses the site to make purchases hereinafter referred to as Customer is required, before sending the order, to carefully read the following General Conditions.

Registration
In order to use the Service or part of it, Users must register by truthfully and completely providing all the data requested in the relevant registration form and fully accept the privacy policy and these general conditions. The User has the duty to guard and keep his access credentials confidential.
It is understood that under no circumstances can the Data Controller be held responsible in the event of loss, dissemination, theft or unauthorized use by third parties, for any reason whatsoever, of the Users' access credentials.
Account cancellation and closure of User accounts
Registered Users can deactivate their accounts, request their cancellation or stop using the Service at any time, through the Touch Terra interface or by contacting the Owner directly.
The Owner, in the event of a violation of these Terms, reserves the right to suspend or terminate the User's account at any time and without notice.

- the User has violated the Agreement; and/or
- access to or use of the Service could cause damage to the Owner, other Users or third parties; and/or
- the use of Touchterra by the User could result in a violation of the applicable law or regulation; and/or
- in caso di investigazioni condotte in esito ad azioni legali o per coinvolgimento della pubblica autorità; e/o
- the account is deemed by the Owner, at its sole discretion and for any reason, inappropriate or offensive or in breach of the Contract or not in line with the standards of the Owner.

Purchase procedure
Each order sent constitutes an offer to purchase the products. Orders are subject to the availability and discretionary acceptance of the Owner.
The User must select the products and complete the check-out, after carefully checking the information contained in the order summary. The order is made by confirming it and is subject to payment of the price, taxes and shipping and payment costs indicated in the Order Summary form. The contract is concluded when the Owner sends the Order Confirmation to the email address provided by the User. The Owner reserves the right not to confirm an order, communicating to the User within 5 working days of placing the order, to the email address associated with his purchase, the possible unavailability of one or more of the products purchased. In this case, the Owner will refund the price and shipping costs incurred by the User.
Terms of payment
Touchterra.it uses third party tools (PayPal) for payment processing and does not in any way come into contact with payment data - such as those relating to the credit card - provided.
Delivery
Deliveries are made during normal working hours to the address indicated by the User and in the manner specified in the order summary. Delivery will take place via GLS courier.

In case of non-collection within the deadline established by the carrier, the products will be returned to the Owner, who will reimburse the price of the products, but not the shipping cost. The Owner cannot be held responsible for errors in delivery due to inaccuracies or incompleteness in completing the purchase order by the User, for damage that may have occurred to the Products after delivery to the carrier, where the latter has been chosen and appointed by the User or for delays in delivery attributable to the latter. Delivery costs vary depending on whether the shipment takes place in Italy, Sardinia or in other countries of the European Union. Shipping costs are calculated based on the weight of the products. Shipping costs are free upon reaching a minimum purchase threshold decided by the owner.
Availability of products
The prices, descriptions or availability of the products displayed are subject to change without notice. The photos inserted are indicative and may not be an exact representation of the products. The Owner will do his best to present the characteristics of the products with the greatest degree of detail possible within each sheet corresponding to the product viewed by the User. However, the images and colors of the products offered may differ from the real ones due to multiple factors including, but not limited to, the User's terminal monitor, photographic filters, etc. Therefore, the User acknowledges and accepts that any such minor differences do not constitute a lack of conformity of the products.
Right of withdrawal and guarantee
In case of purchase of products, the User has the right to withdraw from the contract without indicating the reasons, within 14 days. The withdrawal period expires after 14 days from the day on which the User or a third party – other than the carrier and designated by the User – acquires physical possession of the goods. To exercise the right of withdrawal, the User is required to inform the Owner of the decision to withdraw through an explicit declaration sent to the contacts indicated.

The Customer Service of www.toccareterra.itit will, upon receipt of the communication, open a case for the management of the return and communicate the instructions on how to return the Products to the Customer.
Effetti del recesso
The right of withdrawal is governed by the following conditions:
I. The law applies to the Product purchased in its entirety; therefore if the Product is made up of several components or parts it is not possible to exercise the withdrawal only on part of the Product purchased.
II. In case of exercise of the right of withdrawal,Touch Terra will refund the customer the full amount of the returned goods, including shipping costs where applicable, within 14 days from the date on which the communication of withdrawal was received, without prejudice to the right of the owner company to suspend the payment of the refund until the actual receipt of the goods. The refund will be made using the same payment method used by the Customer
III. The Products must be returned in the same box in which they were received.
IV. In addition to the cases indicated in the Introduction (non-consumer customer and/or requesting an invoice), the right of withdrawal is excluded in the following cases, pursuant to art. 59 legislative decree 21/2014:
- order of Products made to measure or clearly personalized;
- ordering Products that are likely to deteriorate or expire rapidly;
- order of sealed Products that are not suitable for being returned for hygienic or health protection reasons or that have been opened after delivery.
Applicability of the withdrawal clauses
The clauses concerning the exercise of the right of withdrawal, as well as the related consequences and exceptions, apply exclusively to the User who qualifies as a consumer, i.e. to the User who acts for purposes unrelated to his business and professional activity.

Warranty and lack of conformity

The legal guarantees provided for by articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. The Customer has the right, at his choice and provided that the type of Product allows it, to restore, without charge, the conformity of the Product by means of repair or replacement, or to an adequate price reduction or termination of the contract. The Customer forfeits these rights if he does not report the lack of conformity to www.toccareterra.it within two months from the date on which he discovered the defect, provided that it is not a Product which by its nature is perishable or subject to deadline in a shorter period, in which case the defect must be reported within this shorter period.
Errors and Limitations of Liability
The information relating to the Products is constantly updated. However, www.toccareterra.it cannot guarantee the total absence of errors.
We reserve the right to correct errors, inaccuracies or omissions even after an order has been sent, or to change or update information at any time without prior notice, without prejudice to the Customer's rights under these General Conditions and the Consumer Code.
Salvo dolo o colpa grave, viene escluso ogni diritto del Cliente al risarcimento di danni o al riconoscimento di un indennizzo, nonché qualsiasi responsabilità contrattuale o extracontrattuale per danni diretti o indiretti a persone e/o cose, provocati dalla mancata accettazione o evasione, anche parziale, di un ordine.
